This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and CNB Dev LTD for the Casino NB Key software application, which includes the iOS application and any associated media, documentation, and online services ("Software").
By installing, downloading, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
CNB Dev LTD grants you a limited, non-exclusive, non-transferable, revocable licence to use Casino NB Key subject to the terms of this EULA. This licence includes:
Install and use the Software on iOS devices you own or control for your personal guest experience at Casino New Brunswick.
Access and use the in-app services and features in accordance with this agreement and Casino New Brunswick's guest policies.
Sign in with your account credentials as issued by Casino New Brunswick reception staff to access personalised features.
Use the Software solely for your personal, non-commercial purposes during your stay at Casino New Brunswick.
You may NOT do any of the following:
The Software is licensed, not sold. CNB Dev LTD retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of CNB Dev LTD or Casino NB Key.
All software code, interface designs, graphics, branding, text, logic, and all other content within the application.
Your personal data and any user-generated content you create or submit through the Software during your stay.
Your use of the Software is governed by our Privacy Policy. We collect and process your data as described in the Privacy Policy. By using the Software, you consent to such collection and processing. Your room preferences and session data are stored locally on your device and are not shared with third-party advertising or analytics services.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CNB DEV LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Software will be uninterrupted, error-free, or free of harmful components. Casino NB Key is a hospitality convenience tool and does not guarantee specific service outcomes or results.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CNB DEV LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.
This includes, but is not limited to, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses arising from your use of or reliance on the Software.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination:
CNB Dev LTD may provide updates, patches, or modifications to the Software from time to time. These updates may be automatically downloaded and installed on your device. You acknowledge that the Software may require such updates to continue functioning properly. We reserve the right to modify this EULA at any time. Continued use of the Software after any changes constitutes your acceptance of the modified EULA.
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which CNB Dev LTD operates, without regard to its conflict of law provisions. Any disputes arising from this EULA shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, or through the courts of the applicable jurisdiction.
